Abstract
Indian law prohibited
the practice of dowry, or providing presents to the bridegroom's family during
the wedding ceremony. Since to a few persons misusing the law, numerous false
dowry charges have been brought against innocent people in recent years.
Several police agencies have abused this statute to threaten and extort cash
from persons who are accused of committing crimes. Some attorneys have made up
dowry cases in order to increase their fees or settle personal conflicts with
their client. If the Dowry Prohibition Act of 1961 is misused, there are harsh
repercussions. False charges can result in the arrest, harassment, and even
imprisonment of innocent persons. Additionally, it casts doubt on the validity
of the law and makes it challenging to uphold the rights of dowry harassment
victims. The misuse of the act by the police and attorneys should also result
in punishment. Before filing a lawsuit, dowry charges should also be
independently investigated. The exploitation of the Dowry Prohibition Act of
1961 is covered in this chapter along with its reasons, laws, court cases,
prohibition of usage, and recommendations for prevention.
